Regarding indebtedness, the debtor is subject to a registration upon the filing of its dossier to the debt commission .
In the event that the commission has set up a procedure recovery situation, the debtor shall then be placed under the measure, for a period can never exceed 10 years. These measures are divided into:
- conventional measures referred to in Article L. 331-6, set by the commission indebtedness
- judicial measures, which consist of recommendations developed by the same commissions coated enforceable, and the decisions taken by judges of the execution ruling in case of appeal, pursuant to the provisions of Articles L 332.2 and L 332.3 of the Consumer Code. Once debtors have paid all the debts to creditors enrolled in conventional measures or judicial action may be delisted from FICP To do this, debtors must provide to the Bank of France's certificates of payment from all creditors. This possibility is not open for partial deletions of claims, procedures for recovery personnel or judgments pronounced liquidation in Alsace Moselle.
